No one testified during the murder case, it's hard to tell if the murder was a heat of the moment incident or a planned hit.
I think it was a planned hit since many people have spoken very badly of Bruiser Brody. No one liked Brody, Brody made a lot of people angry. My guess is that many wrestlers and promoters secretly paid Invader #1 to do the hit with the guarantee that no one would testify against him.
Tony Atlas was ignorant to what happened and was ready to testify, but he changed his mind and never testified.
Many wrestlers have said that they saw it coming because Brody was a very dirty business man.
